Data Privacy Agreements by State

Data privacy is extremely important to us. Brilliant for Educators is designed in compliance with global privacy laws, including COPPA and FERPA in the US and GDPR in the EEA/UK. We do not share, sell, or disclose any personal information of students, nor do we use it for marketing or other non-educational purposes.

For All Other States

Brilliant is a signatory to data privacy agreements based on the National Data Privacy Agreement (NDPA) and the Student Data Privacy Consortium's (SDPC) state-specific privacy agreements.

The goal of the SDPC is to establish shared standards and expectations around student data privacy, helping districts and vendors align efficiently while ensuring strong protections for student data. When Brilliant signs a state Data Privacy Agreement with a district, other districts within the same state may be able to "piggyback" on that agreement by completing and submitting Exhibit E, allowing them to adopt the same terms without requiring a new agreement.

Note: Due to capacity constraints, Brilliant is only able to sign a limited number of data privacy agreements per semester. We prioritize agreements based on the potential to reach the greatest number of students. If you have questions, please reach out to us at educators@brilliant.org.

Email us a copy of your district's data privacy agreement to educators@brilliant.org.

  • Note that we expect to see agreements that resemble the templates provided on the SDPC website. If your agreement is not in this format, please let us know why.
  • In the email, please also include confirmation that teachers at the school/district will be informed of Brilliant for Educators after the DPA is signed.

We will send the DPA to Brilliant's legal team for review.

If the legal team notes any questions, suggestions, or red-line items, we will relay these to you via email.

Once the agreement is approved by both parties, we will sign the agreement and send it back.

Once your district rep also sign the agreement, please do two important final things:

  • Email us a copy of the fully executed agreement.
  • Upload the executed agreement to the SDPC website. This is super important, so other schools in your district and state can confirm an existing agreement with Brilliant and avoid requesting an unnecessary new DPA!
